An Indian Citizen who stays abroad for employment/carrying on business or vacation outside India or stays abroad under circumstances indicating an intention for an uncertain duration of stay abroad is a non-resident. Àεµ ½Ã¹ÎÀ» ÇØ¿Ü·Î °è¼Ó °í¿ë / ¿î¹Ý ÇØ¿Ü ÃâÀåÀ̳ª ÈÞ°¡ ¿ÜºÎ Àεµ ¶Ç´Â ¾Æ·¡ ¼÷¹Ú ºÒÈ® ½ÇÇÑ »óȲ¿¡ ´ëÇÑ Àǵµ¸¦ ³ªÅ¸³»´Â ÇØ¿Ü ü·ù ±â°£ÀÌ ¾Æ´Ñ - »óÁÖÇÕ´Ï´Ù. (Persons posted in UN Organizations and officials deputed abroad by Central/state Government and Public Sector undertakings on temporary assignments are also treated as non-residents). 2. 2. Who is a person of Indian Origin? Àεµ Ãâ½ÅÀÇ »ç¶÷ ÇÑ »ç¶÷Àº?

For the purpose of availing of the facilities of opening and maintenance of bank accounts and investments in shares/securities in India . availingÀÇ ¸ñÀûÀÇ ½Ã¼³À» °³¹æ°ú ÀºÇà °èÁÂÀÇ À¯Áö °ü¸® ¹× ÅõÀÚ ÁÖ½Ä / Áõ±Ç ÀεµÇÕ´Ï´Ù.

A foreign citizen (other than a citizen of Pakistan or Bangladesh) is deemed to be of Indian Origin, if, he, at any time, held and Indian Passport, or he or either of his parents or any of his grand parents was citizen of India by virtue of the Constitution of India or Citizenship Act, 1955 (57 of 1955). ¿Ü±¹ÀÎ ½Ã¹ÎÀ» (ÆÄŰ½ºÅºÀ̳ª ¹æ±Û¶óµ¥½ÃÀÇ ÇÑ ½Ã¹ÎÀÌ ¾Æ´Ñ)´Â Àεµ¿¡ ±â¿ø °ÍÀ¸·Î °£ÁÖ, ¸¸¾à, ±× »ç¶÷Àº ¾ðÁ¦µçÁö ¿©±ÇÀ» °³ÃÖ¿Í Àεµ, ¶Ç´Â ±× Áß Çϳª ¶Ç´Â ±× Áß Çϳª¸¦ ±×ÀÇ ºÎ¸ð ¶Ç´Â ºÎ¸ð°¡ ½Ã¹Î ±×·£µå ÀεµÀÇ Çå¹ý¿¡ ÀÇÇØ ÀεµÀÇ ¹Ì´ö ¶Ç´Â ½Ã¹Î±Ç ¹ý, 1955 (57ÀÇ 1955).

Note: A spouse (not being citizen of Pakistan or Bangladesh) of and Indian citizen or of a person if Indian Origin is also treated as a person of Indian origin for the above purposes provided the bank accounts are opened or investments in shares/securities in India are made by such persons only jointly with their NRI spouses. For investments in immovable properties. ºÎµ¿»ê¿¡ ´ëÇÑ ÅõÀÚ¸¦ÇÕ´Ï´Ù.

Reserve Bank has granted general permission to foreign citizens of Indian Origin, whether resident in India or abroad, to purchase immovable property in India for their bonafide residential purpose. ¿¬¹æ Áغñ ÀºÇàÀº ÀϹÝÀûÀÎ ±ÇÇÑÀ» ºÎ¿© Àεµ Ãâ½ÅÀÇ Á¶¼± Á¶¼±ÀÇ ½Ã¹ÎÀº, Àεµ¿¡ÀÖ´Â ¿©ºÎ¸¦ °ÅÁÖÇϰųª ÇØ¿Ü ºÎµ¿»êÀ» ±¸¸Å bonafide ÁÖ°Å ¸ñÀûÀÇ ÀεµÇÕ´Ï´Ù. 6. 6. What are the formalities required to be completed by foreign citizen of Indian Origin for purchasing residential immovable property in India under the general permission? ¿¡ ÇÊ¿äÇÑ ¼ö¼ÓÀ» ¿Ï·áÇÒÀº ¹«¾ùÀԴϱî Àεµ Ãâ½ÅÀ¸·Î ¿Ü±¹ÀÇ ½Ã¹Î Àεµ¿¡ÀÖ´Â ºÎµ¿»êÀ» ±¸¸Å ¾Æ·¡ÀÇ ÀϹÝÀûÀÎ »ç¿ë ±ÇÇÑ ÁÖÅÃ?

They are required to file a declaration in form IPI 7 with the Central Office of Reserve Bank at Mumbai within a period of 90 days from the date of purchase of immovable property or final payment of purchase consideration along with a certified copy of the document evidencing the transactions and bank certificate regarding the consideration paid. ±×µéÀº ¾ç½Ä¿¡ ÇÊ¿äÇÑ ÆÄÀÏÀ» ¼±¾ð ipi 7 °³ ¿¬¹æ Áغñ ÀºÇà¿¡¼­ Áß¾Ó »ç¹«¼Ò ¹³¹ÙÀÌ ³¯Â¥·ÎºÎÅÍ 90 ÀÏ À̳»ÀÇ ±â°£¿¡ ºÎµ¿»êÀ» ±¸¸Å ¶Ç´Â ÃÖÁ¾ °áÁ¦ ÀÎÁõ°ú ÇÔ²² °í·ÁÀÇ ±¸¸Å¸¦ Áõ¸íÀÇ ¹®¼­¸¦ º¹»ç °í·Á »çÇ× ¹× ÀºÇà °Å·¡¿Í °ü·ÃÇÏ¿© ÀÎÁõ¼­¸¦ Áö±ÞÇÕ´Ï´Ù.

7. 7. Does such property can be sold without the permission of Reserve Bank? ÀÌ·¯ÇÑ ¼Ó¼ºÀº ¿¬¹æ Áغñ ÀºÇàÀÇ Çã¶ô¾øÀÌ´Â ÆÈ ¼öÀÖ´Ù?

Yes, Reserve Bank has granted general permission for sale of such property. ¿¹, ¿¬¹æ Áغñ ÀºÇàÀº ÀϹÝÀûÀÎ ±ÇÇÑÀ» ºÎ¿© °°Àº ¼Ó¼ºÀÇ ÆÇ¸ÅÇÕ´Ï´Ù. However whether the property is purchased by another foreign citizen of Indian Origin, funds towards the purchase consideration should either be remitted to India or paid out of balance in NRE/FCNR accounts. ±×·¯³ª ´Ù¸¥ ¿Ü±¹ ½Ã¹ÎÀ» ±¸ÀÔÇÑ ÀÖ´ÂÁö ¿©ºÎ¸¦ ¼Ó¼ºÀº Àεµ Ãâ½Å, ÀÚ±ÝÀ» ÇâÇÑ ¹è·ÁÀÇ ±¸¸ÅÇϰųª ÁöºÒ Àεµ¿¡ ÈÛ½ÎÀ̰ųªÀÇ ±ÕÇüÀ» ¼Û±Ý nre / fcnr °èÁ¤À»ÇÕ´Ï´Ù.

8. 8. Can sale proceeds of such property if and when sold be remitted out of India ? ÀÌ·¯ÇÑ ¼Ó¼ºÀº ÆÇ¸Å ¼öÀÍÀÇ ¼Û±Ý ¾Æ¿ôÀº ÀεµÀÇ ¸Å°¢ ¾Ê´Â´Ù¸é ±×¸®°í ±× ¶§?

In respect of residential properties purchased on or after 26 th May 1993 , Reserve Bank considers applications for repatriation of sale proceeds up to the consideration amount remitted in foreign exchange for the acquisition of the property for two such properties. µî·Ï Á¤º¸¿¡¼­ ±¸ÀÔÇÑ ÁÖÅÃÀ» Á¸Áß 1993³â 5¿ù ÀÏ ¶Ç´Â ±× ÀÌÈÄ 26 ÀÏ, ¿¬¹æ Áغñ ÀºÇàÀÇ ¸Å°¢ ¼öÀÍÀ» °í·Á ÀÀ¿ë ÇÁ·Î±×·¥À» ¼ÛȯÀ» °í·Á Àμö¸¦À§ÇÑ ¿ÜÈ­¸¦ ¼Û±Ý ¾×¼öÀÇ Àç»ê¿¡ ´ëÇÑ 2 °³ÀÇ ±×·¯ÇÑ ¼Ó¼ºÀ»ÇÕ´Ï´Ù. The balance amount of sale proceeds if any or sale proceeds in respect of properties purchased prior to 26 th May 1993 , will have to be credited to the ordinary non-resident rupee account of the owner of the property. ¼öÀÍÀº ÆÇ¸Å ±Ý¾×ÀÇ ±ÕÇüÀÌÀÖ´Â °æ¿ì ¶Ç´Â ÆÇ¸Å ¼öÀÍ±Ý 26 ÀÏ ÀÌÀü¿¡ ±¸ÀÔÇÑÀÇ ¼Ó¼ºÀ» Á¸Áß 1993³â 5¿ù°¡ ¾Æ´Ñ ÀϹÝÀ¸·Î Àû¸³ÇØ¾ß - »óÁÖ ·çÇÇ °èÁ¤ÀÇ ¼ÒÀ¯ÀÚÀÇ Àç»êÇÕ´Ï´Ù.

9. 9. Are any conditions required to be fulfilled if repatriation of sale proceeds is desired? ÀÌ ¸ðµç Á¶°ÇÀ» ÃæÁ·ÇÏ¸é ¼öÀÍÀº ÆÇ¸Å ¼ÛȯÀ» ¿øÇϴ°¡?

Applications for repatriation of sale proceeds are considered provided the sale takes place after three years from the date of final purchase deed from the date of payment of final installment of consideration amount, whichever is later. Applications for necessary permission for remittabnce of sale proceeds should be made inform IPI 8 to the Central Office of Reserve Bank at Mumbai within 90 days of the sale of the property. 11. 11. Can foreign citizen of Indian Origin acquire or dispose of residential property by way of gift? Àεµ Ãâ½ÅÀÇ Á¶¼± Á¶¼±ÀÇ ½Ã¹ÎÀº ÁÖ°Å Àç»êÀ» óºÐÇÏ´Â ¹æ½ÄÀ» ÃëµæÇϰųª ¼±¹°?

Yes. yes. General permission has been granted by Reserve Bank to non-resident persons(foreign citizen) of Indian Origin to transfer by way of gift immovable property held by them in India to relatives and charitable trust/organizations subject to the conditions that the provisions of any other law, including Foreign Contribution (Regulation) Act, 1976, as applicable, are duly complied with.
